For deletion requests, you will be required to submit a verifiable deletion request and then separately confirm that you wish to have the information about you deleted.
How to make a request

When you can expect a response from us
We will confirm receipt of your request within 10 working days and inform you of how we will process your request, including the verification process and expected response time. CONDITIONS FOR RETURN OR EXCHANGE
CUCCHETTI (“We”, “us”, “our”) accepts returns or exchanges of CUCCHETTI products (“Products”) eligible for return (as defined in the general conditions of sale of CUCCHETTI) within 30 calendar days from receipt of such Products.
The right of withdrawal does not apply to orders of personalized Products and to all other Products for which you have been informed, at the time of placing the order, of their non-returnability (in accordance with the legislation in force) (“Non-returnable Products”) .
We accept exchanges only for a different size of the same Product (same price/same color). If you wish to receive a different Product or the same Product, but in a different colour, you must return the Product and ask for a refund. You can then place a new online order for the desired Product.
The Products must be returned in their original condition, unaltered, unused, without damage, in the original packaging, with the original labels attached and with the relevant accessories and documents (for example, instruction booklet, Product certificates), and with the protections adequate.
Returns or exchanges of incomplete, altered, worn, damaged or stained Products will not be accepted and will be returned to you.
The above provisions do not affect your legal rights in relation to Products which have manufacturing defects or which do not conform to the description.
RETURN OR EXCHANGE PROCEDURE
Before returning a Product, you must notify us of your intention to return or exchange the Product. You will receive an email confirming your return or exchange request containing the following instructions to return the Product(s) to our warehouse or nearest store:
- Carefully package the Products you intend to return or exchange so that they do not get damaged. Place them in the original packaging, if any, then in the shipping box in which you received the order;
- Glue the prepaid label found inside the shipping box onto the original label and close the box securely. If you have lost the label, please contact our Customer Service Department. If you do not use our return label, we will not be responsible for any theft or loss that may occur in transit.
- Visit the courier’s website or contact Customer Service to arrange collection. Alternatively, you can leave the box at the courier delivery point closest to you;
or
- Return the Product(s) purchased online from an Italian website to any CUCCHETTI point of sale in Italy (excluding department stores).
Please note that the Products must be returned within 14 calendar days of the return or exchange request.
REFUNDS AND EXCHANGES
Upon receipt of a Product for which a return or exchange has been requested, we will check the Product to ensure that the conditions for return or exchange indicated in Article 1 above are met. If the Product meets these conditions, an exchange or refund will be made.
The Customer is responsible for any reduction in the value of the Products resulting from manipulations of the same other than those strictly necessary to ascertain the nature, characteristics and functioning of the Products.
Refunds will be made to the original purchaser, using the original payment method and original currency, except in the case where the payment was made by cash on delivery: in this case the refund will be made by bank transfer.

1.1.CUCCHETTI SRL, a company established in accordance with Italian legislation, with share capital of €10,000, with registered office in Via Fabio Filzi, 2, 20124 Milan, Italy, registered with the Chamber of Commerce of MILAN MONZA BRIANZA LODI with registration MI- 2690593, with VAT number 12885660964, in accordance with the management and coordination of CUCCHETTI SRL (“CUCCHETTI”, “we”, “us”, “our”), sells, and a consumer (“ you”) purchases CUCCHETTI products (“Products”) through the website https://saracucchetti.com/en/ (“Website”).
1.2. Our General Conditions apply to contracts for the sale of CUCCHETTI Products through the website (“Contract”).
1.3. The sale of the Products through the website is available exclusively to consumers, i.e., based on article 3 of Legislative Decree 206 of 6 September 2005 (“Italian Consumer Code“), natural persons who purchase for the purposes of personal consumption (i.e. who act for purposes unrelated to their commercial, entrepreneurial, artisanal or professional activity and not for profit). If you have not yet reached the age of majority, you must expressly confirm that you have the authorization of a parent or legal guardian to purchase the Product before submitting the order.
1.4. You will be asked to accept our Terms and Conditions and our Website Terms of Use (“TOU”) before placing your order. We therefore recommend that you read these documents carefully, in particular our General Conditions, before proceeding with purchases, and save or print them for future reference. Failure to accept our General Conditions and/or the TOU will make it impossible to order the Products from the website.

While we make every effort to display the Products accurately, we cannot guarantee that the display of our products on your devices will be accurate. 2.3. 3.1.The prices of the Products are indicated on the website in Euros and include VAT and all applicable taxes and sales duties. Prices do not include shipping costs, which, if due, will be added to the price of the Products and will be indicated to you during the purchase process, before confirming the order.
3.2. We use reasonable endeavors to ensure that all prices for Products shown on the website are correct. In the unfortunate event that the price of a Product is incorrect (wrong price or typographical error in the price indicated), we will cancel your order and terminate the Contract.

4. SUBMITTING THE ORDER – STIPULATING THE CONTRACT

4.5. Order Acceptance includes your order number, information required by applicable law, including, but not limited to, basic information about the Products purchased, price, and shipping address. Details of your accepted orders are available in the “My Account” or “My Profile” section, if you have created an account or profile.
4.6. Once you have received your Order Confirmation, you will no longer be able to cancel or modify your order, without prejudice to your legal rights under Sections 9 and 11.
5. PAYMENT
5.1. You must pay the price of the Products (including applicable VAT, taxes and sales duties), the cost of any additional services you order (for example, the additional cost for customized Products) and the related shipping costs, if foreseen.
5.2. We accept payments in the currency indicated for the country of destination of the shipment with the payment methods proposed to you before confirming the order. We may offer payment methods (such as Paypal) for which you must accept the terms and conditions of the payment service provider. These terms and conditions can be consulted by clicking on the link that will be communicated to you before confirming the order. We do not accept any liability in relation to your use of the payment method in question. This payment method may not be available for all purchases and your suitability for using this payment method will be determined by the payment service provider on a case by case basis.
5.3. The amount of the order will not be charged until the moment of shipment.
5.4. If for any reason your payment cannot be processed, we will cancel your order and our Contract will end immediately, without any liability to you. In this case you will receive written communication.
5.5. You are responsible for any fees or charges imposed by your card company, bank or other payment institution as a result of our processing of your payment.
5.6. For each order we will issue an electronic document relating to the Products purchased, and you must accept this form of invoicing. The electronic invoice is based on the information you provide when placing your order.
6. PRE-ORDER OF PRODUCTS
6.1 We may offer you the opportunity to pre-order selected Products on the website before they are available for sale in stores or on the website (“Pre-order Products”). You can add the pre-order Product to your cart order and finalize the order submission process in accordance with Section 4. The thirty (30) day delivery period set out in Section 7.3 applies to pre-order Products only if we notify you that the pre-order Product is available /it has been sent.
7. SHIPPING, DELIVERY AND COLLECTION
7.1. The purchased Products can only be shipped to the countries mentioned on the site.
7.2. The Products purchased are shipped via a carrier selected by us (“Carrier”). The Products will be shipped to the address indicated by you on the order form or to one of our stores offering in-store collection service in the country of shipping, as selected by you (“Selected Store“).We are not responsible for shipping problems that may occur as a result of an incomplete or incorrect address provided by you. Please note that we do not ship to post office boxes, shipping addresses or hotels (we may exceptionally agree to ship the Product(s) to a hotel, but such shipping is in any case subject to our prior express approval).
7.3. We will take all reasonable steps to ship the purchased Products or to make them available for collection at the store selected by you within the periods estimated and communicated before sending the order and, in no case, not later than thirty (30) days from the Order Confirmation, except in cases of force majeure events.
7.4. We will send you an email to let you know when your order has shipped. If delivery has not occurred within thirty (30) days of Order Confirmation, you may (i) notify us of the suspension of payment of the entire price or part thereof until such time as we ship the Product or (ii) indicate a delivery date and, if this new date cannot be respected, you may terminate the Contract. In such event we will refund any amounts paid under the Contract within fourteen (14) days of the date of termination of the Contract.
7.5. Upon delivery of the Products by the Carrier, you (or your designated representative) should:
(i) verify that the number of packages delivered corresponds to that indicated on the delivery note;
(ii) verify that the packages and seals are intact, that they are not damaged, damp, or otherwise altered;
Complaints regarding package damage or discrepancies in the number of packages must be reported in accordance with applicable law.
7.6. You can track the status of your shipment by clicking on the link included in the Order Shipping Confirmation.
7.7. If you have selected to collect the Products from the selected Store, you will have a limited period of time available for collection, as indicated via e-mail. To collect the Products in store you must have the Order Confirmation and an identity document with you. If you have appointed a person to collect the Products, that person must present a proxy duly signed by you, together with a copy of your identity document.
8. RISK AND OWNERSHIP
8.1. The shipped Products remain our property until full payment of the purchase price. Ownership of the Products therefore passes to you when full payment has been processed.
8.2. The risk of loss, damage and/or destruction of the Products is transferred to you (or is transferred to a person indicated by you, who is not the carrier) when you take possession of the Products at the delivery address provided by you or at the time of the collection of the Products at the selected store by you or by the person indicated by you.
9.RIGHT OF WITHDRAWAL AND RETURNS
9.1.You have the right to withdraw or cancel the Contract without having to present any reason within thirty (30) days from the date on which you (or the person indicated by you) took possession of the Products or, in the case of multiple packages shipped for the same order, of the last package delivered.
9.2.The right to cancel does not apply to orders for personalized Products and Products identified on our website as non-returnable products (“Non-returnable Products”), without prejudice to your legal rights under Section 11.

You can use the withdrawal form found at the bottom of the General Conditions, but it is not mandatory.
To respect the withdrawal deadline, it is sufficient to send the communication regarding the exercise of the right of withdrawal before the end of the withdrawal period (see Section 9.1).
9.4.If you withdraw from the Contract, we will refund the amounts we have received from you, including shipping costs, (with the exception of additional costs resulting from your choosing a type of delivery that is not the cheapest shipping method we offer) , without unjustified delay and in any case no later than fourteen (14) days from the date on which we were informed of your decision to withdraw from the Contract. We will refund you using the same payment method you used for the initial order, unless you have expressly made different arrangements. In any case, no charges will be applied to this refund. We may withhold the refund until we receive the returned Products.
9.5 You must send the Products back or deliver them to us at the address indicated in the instructions attached to the return label, without unjustified delay and in any case no later than 14 days from the date on which you communicated your withdrawal from the Contract. The deadline is met if you send us the Products before 14 days have passed.
9.6 You will have to bear the direct costs for returning the Products if you do not use the attached return label.
9.7. The Products must be returned in their original condition, unaltered, unused, without damage, in their original packaging, with the relevant accessories and labels and with the relevant documents (for example, instruction booklet, Product certificates, etc.) if present.
9.8. If a returned Product does not meet the conditions required for return, as indicated in Section 9.7 above, we will return the Product to you at the address indicated on the return form, or, if this address is not valid, at the address you communicated when you submitted the order. The return will be made within fourteen (14) days from the date on which we communicated to you the refusal of the returned Products, unless an event of force majeure, an event beyond our reasonable control or unforeseeable circumstances occurs.
9.9.You will be responsible for any reduction in value of the Products resulting from handling other than that required to establish the nature, characteristics and functioning of the Products.
9.10. If the option to return in store is available (refer to the instructions attached to the return label), you can return the Products purchased through the website to one in our stores in Italy within the times indicated in Section 9.5 above.
9.11. The provisions of Sections 9.1 to 9.10 apply in addition to our Returns Policy
10.CHANGE OF PRODUCTS
10.1. Without prejudice to your legal rights under Sections 9 and 11, and except for non-returnable products, we accept exchanges of Products purchased on the website within (30) days of the delivery date, in accordance with the procedure set out in our Returns Policy. Only the exchange of the Product (same price / same color) with the same Product of a different size is permitted. If you wish to receive a different Product or the same Product, but in a different colour, you must return the Product and request a refund. You can then place a new online order for the desired Product.
10.2. All exchanges are subject to the availability of the new Product requested. The Products can only be exchanged once.
10.3. We reserve the right to reject returned Products and to refuse exchange if the Products returned for exchange do not meet the conditions set out in Section 9.5.

11. LACK OF CONFORMITY – DEFECTS

11.2.We provide the guarantee in case of lack of conformity with the Contract for the Products that we have sold to you on the website under the conditions established in Article 128 et seq. of the Italian Consumer Code. As part of the legal guarantee of conformity, we are responsible for any lack of conformity that occurs within two years from the date on which you (or the person you have appointed) physically took possession of the Products, both at the delivery address and communicated or at the selected Store. Under penalty of forfeiture, you have a period of twenty-six (26) months from the date indicated above to submit a complaint: You can choose whether to repair or replace the Product, free of charge, unless, as established in Article 135-bis of the Italian Consumer Code, the cost of the solution you have chosen is disproportionate to the cost of the alternative solution or this solution is impossible, in which case you will be entitled, in accordance with the conditions of Article 135-bis et seq., to a price reduction paid for the Product or upon termination of the Contract. 11.3. Damage, alterations or modifications to the Products caused by you are not considered defects or lack of conformity. For example, without limitation, damage caused by heavy use or wear and tear; improper use (such as direct exposure to sunlight or heat, contact with liquids, rain or food); normal wear and tear and failure to follow care and/cleaning instructions are not considered defects or lack of conformity. Similarly, variations in texture, normal marks or irregularities of natural products (such as leather or fabric) are inherent to the Product and do not constitute defects.
11.4.In the event that you request repair, replacement or return of a Product due to defects or because the Product is not as described or is incomplete, in accordance with Section 11, we will bear the shipping costs for the return of the Products to be repaired, replaced or returned, as well as the costs of sending the repaired or replaced Products back to you.
12. RESPONSIBILITY
12.1. Nothing in these Terms and Conditions is intended to exclude or limit our liability for:
· personal injury or death resulting from our negligence;
· fraud or fraudulent misrepresentation;
· violation of obligations under current consumer protection laws; or
· other legal actions which cannot be limited or excluded by us under applicable law.
12.2. Subject to the foregoing, we remain liable for damages caused by our breach, suffered by you in relation to claims and legal actions arising under or in connection with these General Conditions and each Agreement, except for any delay or failure of our obligations under our Terms and Conditions, if such delay or failure is caused by a force majeure event.
13. GUARANTEE OF AUTHENTICITY AND INTELLECTUAL PROPERTY RIGHTS

The CUCCHETTI trademarks, figurative or otherwise, service marks, other trademarks, brand names, logos used on the Products, related accessories and/or packaging, whether registered or not, together with photographs, illustrations , the images relating to the Products, the trade names or commercial names, the domain names and URLs are and remain the exclusive property of CUCCHETTI SRL (a company registered in the Trade Registry) and are protected by the laws on copyright, trademarks and on intellectual property in force worldwide. CUCCHETTI reserves all rights indicated.
14.PROMOTIONS AND SPECIAL OFFERS
14.1. Our promotions and special offers are subject to change. The conditions of such promotions and special offers are indicated on the website (for example, beginning and end of promotions and offers; possible minimum order value). Promotions and offers cannot be used in conjunction with other promotions and other offers . To receive the discount or offer applied, you must submit your order within the specified date range.
